The fourth schedule of the Constitution of the Federal Republic of Nigeria list the Functions of a Local Government Council – Section 1 (e) states clearly that Local Government Councils are vested with powers for the “…establishment, maintenance and regulation of slaughter houses, slaughter slabs, markets, motor parks and public conveniences” and as indicated in Section 1 (k) (iii), Local Government Councils are vested with the powers to “control and regulate shops and kiosks”

From the foregoing sections of the Nigerian Constitution, the Delta State Government does not have the constitutional powers to relocate the Ughelli Main Market, as such powers rest with the Local Government Council. This is a clear case of abuse of Executive powers and must be challenged in the court of Law.
