I HAVE NOT DECAMPED FROM DPP TO PDP – HON. EDOJA RUFUS AKPODIETE (UGHELLI NORTH 2)

As a follow up to a post on Liberate – Delta People’s Movement by Mr Victor Oghenekome, on 7th March 2012, alleging that DPP members representing Ughelli North and Uvwie Constituencies in the Delta State House of Assembly had cross carpeted to PDP, we attempted to look at the constitutional implications. Section 109(1) (g) of the Constitution of the Federal Republic of Nigeria 1999 (As Amended) stipulates that: –
“A member of a House of Assembly shall vacate his seat in the House if being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which he was elected. Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored.”

Going by the above provisions of the constitution, it was muted that, if it is true that the DPP legislators, Hon. Akpodiete Edoja Rufus (Ughelli North II) and Hon. Efe Ofobrouku (Uvwie) have cross carpeted to PDP, they should vacate their seats in the Delta House of Assembly, to allow for a bye-election to be held by INEC.

In trying to put the records straight and to refute the post by Mr Victor Oghenekome, I was contacted today by Mr Wisdom Obukofe, DPP Agbarho Ward Leader, who stated that the allegation that Hon. Akpodiete Edoja Rufus had decamped from the DPP to PDP is untrue. This led to a telephone interview with Hon. Akpodiete, in which he categorically denied ever cross carpeting to PDP. He said “I never told any person(s) that I have decamped to the PDP. On the day it was announced that two new members of the House have joined the PDP, I was present at the sitting and I was not one of those that decamped”. He went further to state that the allegation was “an attack on the corporate interest of the people of Ughelli North Constituency and a ploy to cause confusion and disaffection amongst his constituents”.

Mr Victor Oghenekome posted on Liberate – Delta People’s Movement facebook page to confirm that the two members of the Delta State House of Assembly who decamped to the People’s Democratic Party (PDP) are Hon. (Barr.) Samuel O. Mariere (UNDP) representing Ughelli North 1 Constituency and Hon. Efe Ofobrouku (DPP) representing Uvwie Constituency.  Therefore, going by Section 109(1) (g) of the Constitution of the Federal Republic of Nigeria 1999 (As Amended), Hons Mariere and Ofobrouku should vacate their seats in the House, to allow for a bye-election to be conducted by INEC.

    This has always been the case. When they disgruntled in the PDP, they use a less popular political party to gain limelight and then, dump same for the PDP. So, it’s same old story.
